PRIVACY POLICY AND PERSONAL DATA COLLECTION
1 Who collects your personal data?
LivePharmacy and its affiliated or subsidiary companies (hereinafter referred to as "LivePharmacy"), with its address for receiving notifications at Calle Cangrejo No.54, Colonia Villas La Playa, Puerto Morelos, Quintana Roo, Postal Code 77580, is responsible for the processing of personal data provided by the data subjects. In accordance with the Federal Law on Protection of Personal Data Held by Private Parties (the "LFPDPPP") and other applicable legislation, this Privacy Notice (hereinafter referred to as "Notice") sets forth the terms and conditions under which the personal data of the data subjects is processed. The data subject declares (i) that this Notice has been made known to them by the Data Controller, (ii) that they have read, understood, and agreed to the terms set forth in this Notice, thereby giving their consent regarding the processing of their personal data. In the event that the personal data collected includes financial or asset-related data, by signing the corresponding contract, either in printed format or using electronic means and their corresponding consent formation processes, acts constituting the data subject's express consent will be carried out, and (iii) that they consent to the Data Controller making transfers and/or remissions of personal data in accordance with the provisions of section 5 of this Notice.
2 What personal data do we process?
LivePharmacy may collect the personal data of the data subject through direct and/or personal delivery by any means of contact between the data subject and the Data Controller. It may also collect personal data indirectly through public access sources and other market-available sources. To carry out the purposes described in this Notice, LivePharmacy will process identification data, contact data, and financial and/or asset-related data. Additionally, sensitive data related to the products it sells, which may reveal aspects concerning the data subject's health status, and in some of its facilities, biometric data.
3 For what purposes will we use your personal data?
Primary Purposes: LivePharmacy will process the data subject's personal data in order to fulfill obligations arising from any legal and commercial relationship established for the production, marketing, distribution, importation, and exportation of various goods and related services requested by the data subject (collectively referred to as "the products"); to facilitate medical guidance, medication supply; to provide clinical analysis laboratory and optical services; to carry out payment processes; home delivery service; online purchases; invoicing; collection; credit; customer contact; handling inquiries, clarifications, suggestions, returns, and management of websites and software applications; to comply with obligations set forth in applicable health legislation and/or to fulfill the same authority's requirements. Additionally, for activities related to access control and safeguarding material and human resources within the Data Controller's facilities.
Secondary Purposes: LivePharmacy will process the data subject's personal data for other purposes that allow and facilitate providing better service and products tailored to their preferences and needs. These purposes include sending notifications of offers, notices, and/or promotional messages; communications for marketing, advertising, or telemarketing of new or existing products and services, whether proprietary or from business partners; newsletter subscription; conducting surveys; statistics; market studies, records, and histories about consumption habits, interests, and behavior through automatic data capture tools; loyalty programs, benefits, and incentives; participation in social networks, chats, and/or discussion forums; participation in events, quizzes, contests, raffles, games, and lotteries; evaluating the quality of products; and generally for any activity aimed at promoting, maintaining, improving, and evaluating its products.
You can object to the processing of your data for secondary purposes through the means available for exercising your ARCO rights. If you do not object within five business days after your data was collected, it will be understood that you have given your consent.
4 Why do we record video in our facilities?
Anyone entering LivePharmacy's facilities may be recorded by security cameras. Images captured by the closed-circuit television system's cameras will be used to ensure the security of our facilities with the purpose of monitoring LivePharmacy's properties and detecting any risk conditions to minimize them. Additionally, to safeguard material and human resources within the facilities. The photographs and biometric data collected are intended for access control in some of our facilities.
5 With whom do we share your information?
LivePharmacy does not sell, transfer, lease, or give away personal information collected for the aforementioned purposes at the time of registration or when making transactions with its servers.
Databases are not shared with third parties except for founded and motivated requests from competent judicial authorities in accordance with the LFPDPPP.
LivePharmacy requires sharing the data subject's personal data to fulfill its legal and/or commercial obligations, for which it has entered or will enter into various commercial agreements both nationally and internationally. Recipients of personal data are obligated by the corresponding contract to maintain the confidentiality of the provided personal data and to observe this Notice.
LivePharmacy may communicate the collected personal data to any other company within the same corporate group to which the Data Controller belongs and that operates with the same internal processes and policies, for processing with the same purposes described in this Notice.
6 How can you access, rectify, or cancel your personal data, or object to its processing?
You may at any time exercise your ARCO rights (access, rectification, cancellation, or objection) regarding your personal data by submitting a request in the format provided for this purpose, which must contain the following information and documentation:
6.1 Name of the data subject and address or other means to communicate the response to your request;
Current documents that prove your identity (simple copy in printed or electronic format of your voter ID, passport, or FM2 or FM3 visa) or, if applicable, the legal representation of the data subject (simple copy in printed or electronic format of the power of attorney with the data subject's autograph signature, the representative and their corresponding current official identifications: voter ID, passport, or FM2 or FM3 visa)
6.2 A clear and precise description of the data for which you seek to exercise any of the ARCO rights, and
6.3 Any other element or document that facilitates the location of the data subject's personal data.
In the case of requests for rectification of personal data, the data subject must also indicate the modifications to be made and provide the documentation supporting their request.
To comply with the obligation to provide access to your personal data, the data subject's identity or the representative's identity will be verified beforehand, making the information available on-site at the Data Controller's address. Another means may be agreed upon between the data subject and the Data Controller, as long as the requested information permits.

LivePharmacy will respond to the data subject within a maximum period of twenty business days from the date the request was received to make it effective, if applicable, within fifteen business days after the response is communicated. In all cases, the response will be provided via the same means by which the request was submitted or, if applicable, by any other means agreed with the data subject. The aforementioned periods may be extended in terms of the LFPDPPP.
7 How can you limit the use and disclosure of your personal data?
LivePharmacy will retain the data subject's personal data for the time necessary to process their information requests and requested products, as well as to maintain accounting, financial, and auditing records in accordance with the LFPDPPP and applicable commercial, fiscal, administrative, and other current legislation.
The collected personal data will be protected by appropriate administrative, technical, and physical security measures against damage, loss, alteration, destruction, or unauthorized use, access, or processing, in accordance with the provisions of the LFPDPPP and other applicable legislation. Notwithstanding the above, LivePharmacy does not guarantee that unauthorized third parties cannot access the data subject's or the Data Controller's physical or logical systems or the electronic documents and files stored in their systems. Consequently, LivePharmacy will not be responsible for any damages that may arise from such unauthorized access.
You or your duly accredited legal representative may limit the use or disclosure of your personal data through the same means and procedures provided for exercising ARCO rights. If your request is appropriate, you will be registered in the exclusion list provided by LivePharmacy to stop receiving information related to advertising or marketing campaigns. If you believe that your right to personal data protection has been violated in any way, you can contact the National Institute of Transparency, Access to Information, and Protection of Personal Data ("INAI").
8 What data do we collect when browsing our websites, mobile applications, and web pages?
LivePharmacy may collect data through its websites or by using automatic data capture tools. These tools allow collecting information sent by your browser or mobile device to these websites or mobile applications, such as the type of browser you use, user language, access times, and the IP address of websites you used to access LivePharmacy's websites.
Among the automatic data capture tools used on our websites and web pages are cookies, Web beacons, and links in emails. We may collect data about the mobile devices used to access our services, including hardware models, IP addresses, or other unique device identifiers, including the International Mobile Equipment Identity (IMEI), operating systems and versions, software, preferred languages, advertising identifiers, and information about mobile networks or device movement.
